B.Place of Contract Formation and Jurisdiction
1. You agree that all legal issues relating to these Terms and Conditions and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the Tribe and to the extent the Tribe's law does not directly or indirectly address a legal issue, the laws of the State of Minnesota without giving any effect to any principles of conflicts of law that might direct the application of the laws of any other jurisdiction. In the event of a conflict between the laws of Tribe and the laws of the State of Minnesota, the laws of the Tribe shall apply.
2.The Terms and Conditions shall be deemed fully executed and performed on the Prairie Island Indian Community reservation and shall be governed by and construed in accordance with the laws thereof. The Prairie Island Indian Community Tribal Court shall have exclusive jurisdiction over the Terms and Conditions. You agree that any legal proceeding shall only be brought before the Prairie Island Indian Community Tribal Court. You agree that no action shall be brought in any other state or federal jurisdiction. A party may enforce an order, judgment or verdict of the Prairie Island Indian Community Tribal Court in a state, federal, or other tribal court. Nothing in the Terms and Conditions shall be construed or interpreted to affect a waiver of the Prairie Island Indian Community's sovereign immunity. No waiver of the Prairie Island Indian Community's sovereign immunity from suit may be implied from any action or document. You affirmatively consent to the jurisdiction of, and agree that venue is proper in, the Prairie Island Indian Community Tribal Court in any such legal action or proceeding.
C.playTIcasino
1.PlayTIcasino includes a gaming platform that allows you to participate in the games by means of a free Standard Account. Moreover, Treasure Island may offer one or more playTIcasino apps and/or other applications ('playTIcasino apps'), within which the user can apply for and use a Standard Account. Therefore, the Standard Account can be used on the websites of playTIcasino and also in the playTIcasino apps. Separate terms and conditions of use for the playTIcasino apps are set forth on Section L below. Detailed information about the services which cover Treasure Island Apps can be found in the FAQ section of the playTIcasino website.
2.Treasure Island may, at its own discretion, also make access to the gaming platform and games, playTIcasino apps and the contents offered therein, respectively, as well as the playTIcasino website or portions of any of the foregoing, subject to other terms and conditions (such as a particular account type). Such terms and conditions shall be communicated on the relevant website or portion thereof, on a case-by-case basis. Furthermore, the access to the gaming platform and games, playTIcasino apps and the contents may be temporarily or permanently suspended, terminated, modified or limited at any time, which shall be communicated on the website on a case-by-case basis.
3.Treasure Island reserves the right to extend, change, complement, suspend, terminate or limit the range of services at any time.
D.Conditions of Participation
1.The right to participate in the games and use the playTIcasino and playTIcasino apps, exists only within the scope actually offered by Treasure Island in each case, considering all conditions and/or limitations introduced by Treasure Island. Such limitations and/or conditions can apply to all users, user groups or individual users. The scope of services concerning the games offered within the playTIcasino apps may not correspond with the scope of services on playTIcasino.com and the games offered therein.
2.You are solely and entirely responsible for providing any user device needed to access and use playTIcasino and playTIcasino apps, and the technical configuration of such device. The details of recommended configuration can be found in the Help and FAQ sections of the website. The Operator may offer free e-mail or online support. There is no guarantee that e-mails will be answered within a particular time period.
3.Any additional benefits beyond the aforesaid offered free of charge do not form part of the performance obligations and may be discontinued by the Operator at any time.
E.Registration and Accounts
1.Standard Account
1.1.Users may be required to create a 'Standard Account' to access and/or use playTIcasino and/or playTIcasino apps. If you create an account, you must properly complete the registration process on playTIcasino.com or within one of the playTIcasino apps. The Standard Account can be used within playTIcasino and the playTIcasino apps. You must provide truthful and accurate information to Treasure Island in creating such account. If Treasure Island has reasonable grounds to suspect that you have provided any information that is inaccurate, not current or incomplete, it may refuse to register your account and/or suspend or terminate your account and your ability to use or access playTIcasino and/or playTIcasino apps (or any portion thereof).
You are solely responsible for all activity on any and all of your playTIcasino account(s) and for the security of your computer system. You should not reveal your username or password to any other person. You agree to indemnify and hold Treasure Island, the Tribe and their respective affiliates, employees, contractors, officers, directors, agents, representatives, vendors, and content providers harmless for any improper or illegal use of any of your Treasure Island account(s). This includes illegal or improper use by you or someone to whom you have given permission to use your playTIcasino account(s), or the websites or apps associated therewith or whom you have negligently allowed to access your playTIcasino account(s). Treasure Island reserves the right to suspend or terminate your account(s) if any activity that occurs with respect to such account(s) violates these Terms and Conditions or otherwise is deemed necessary or desirable to protect Treasure Island and/or its other users.
1.2.Each individual may only open one standard account. The registration of a Standard Account is currently free of charge (but Treasure Island reserves the right to change this policy) and currently allows the user to access standard games and the following features:

2.Registration for a Standard Account
2.1.You must be eighteen (18) years old (or the age of majority in your jurisdiction, if applicable) to create an account. Your registration must include the following details which must be stated correctly and completely without providing any misleading information:

2.2.This contract between you and Treasure Island on the use of the contents and services offered at playTIcasino and the playTIcasino apps, is effective upon proper completion of the registration process.
2.3.You agree to keep your personal data up-to-date at all times, and to correct the user data by contacting Treasure Island via email at support@playticasino.com or through online profile settings if provided, in the event of any changes of name, address, e-mail, or other account information.
F.Property Rights to Contents
1.By registering an account and/or using playTIcasino and playTIcasino apps, you acknowledge that the entire contents of playTIcasino and the playTIcasino apps are the sole and unrestricted property of Treasure Island. The names and logos, and other graphics, logos, icons, and service names associated with playTIcasino and the playTIcasino apps are trademarks, registered trademarks or trade dress of Treasure Island or its licensors. You may not use Treasure Island trademarks and trade dress in connection with any product or service that is not owned or operated by or on behalf of Treasure Island, or in any manner that is likely to cause confusion among consumers or that disparages or discredits Treasure Island. The compilation of all content on playTIcasino and playTIcasino apps is the exclusive property of Treasure Island and is protected by United States and international copyright laws. You may not use, copy, transmit, modify, distribute, or create any derivative works from any content from playTIcasino and playTIcasino apps unless Treasure Island have expressly authorized you to do so in writing. All other trademarks not owned by Treasure Island that appear on playTIcasino and the playTIcasino apps are the property of their respective owners, who may or may not be affiliated with or connected to Treasure Island. In the event legal action is taken against you for your acts and/or omissions with regard to any content on playTIcasino and the playTIcasino apps, you agree to indemnify and hold harmless Treasure Island, the Tribe and their respective employees, contractors, officers, directors, shareholders, agents, representatives, vendors, and content providers. You agree to use playTIcasino and the playTIcasino apps and any contents and information contained therein, exclusively for personal use and not for any commercial purposes. You shall refrain from changing, copying, publishing, distributing or otherwise exploiting any of the aforesaid. You shall refrain from interfering with the playTIcasino and Treasure Island Apps, and any contents and information contained therein, or the use and enjoyment thereof by other users, by technical means in any form whatsoever.
2.You may submit User Content to playTIcasino and Treasure Island Apps. Treasure Island does not guarantee any confidentiality with respect to any User Content you submit. You retain any ownership rights you have in your User Content. However, by submitting User Content to Treasure Island ONLINE or Treasure Island Apps, you hereby grant Treasure Island, and its business partners who develop, operate, update and/or maintain the Treasure Island ONLINE or Treasure Island Apps, a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with playTIcasino or the playTIcasino apps and Treasure Island's business, including without limitation for promoting and redistributing part or all of playTIcasino and the playTIcasino apps (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of playTIcasino and the playTIcasino apps a non-exclusive license to access your User Content through playTIcasino.com and the playTIcasino apps, and to use, reproduce, distribute, display and perform such User Content as permitted through the functionality of playTIcasino and the playTIcasino apps and under these Terms of Service. The above licenses granted by you are perpetual and irrevocable. You agree you shall not make any claim for compensation for the foregoing. If you submit any USER Content to the playTIcasino and the playTIcasino apps, you acknowledge and agree that such USER Content does not constitute confidential information and represent that you shall be solely responsible for your own USER Content and the consequences of submitting your USER Content. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to submit and publish the content you submit; and you license to Treasure Island all patent, trademark, trade secret, copyright or other proprietary rights in and to such content for publication on playTIcasino and the playTIcasino apps. You further agree that content you submit will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant all of the license rights granted herein.
3.Any and all software, content and services (including advertising) within playTIcasino and the playTIcasino apps that are not owned by or licensed to Treasure Island are 'third party content and services.' Treasure Island acts merely as an intermediary service provider of, and accepts no responsibility or liability for, third party content and services. In addition and without limiting the generality of the foregoing, certain playTIcasino and playTIcasino apps may include links to sites operated by third parties, including advertisers and other content providers. Those sites may collect data or solicit personal information from you. Treasure Island does not control such sites, and is not responsible for their content, policies, or collection, use or disclosure of any information those sites may collect.
4.The Digital Millennium Copyright Act (DMCA) provides recourse to copyright owners who believe that their rights under the United States Copyright Act have been infringed by acts of third parties over the Internet. If you believe that your copyrighted work has been copied without your authorization and is available on or in a playTIcasino Service in a way that may constitute copyright infringement (and after considering whether such use is a 'fair use'), you may provide notice of your claim to Treasure Island's Designated Agent listed below. For your notice to be effective, it must include the following information:
(i)A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii)A description of the copyrighted work that you claim has been infringed upon;
(iii)A description of where the material that you claim is infringing is located within the playTIcasino;
(iv)Information reasonably sufficient to permit Treasure Island to contact you, such as address, telephone number, and, if available, an e-mail address at which you may be contacted;
(v)A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
(vi)A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to the Designated Agent:
-Your physical or electronic signature;
-Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
-A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
-Your name, address, telephone number, and e-mail address, a statement that you consent to the relevant jurisdiction, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by the Designated Agent, Treasure Island may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Treasure Island' sole discretion.
Treasure Island has adopted and reasonably implements a policy to terminate repeat infringers. We reserve the right to termination your account if, under appropriate circumstances, you are determined to be a repeat infringer for DMCA purposes.
G.Proper Conduct
1.Improper conduct on playTIcasino and the playTIcasino apps is strictly prohibited, and you agree not to engage in such activity, including but not limited to:
- breaking the rules regarding communication between users (see point H);
- deliberately submitting false or misleading information;
- any attempt to influence the result of a game by collusion, tampering with the program or by any other means contrary to the rules;
- causing malfunctions or failure deliberately in order to influence the course of a game;
- creating several gaming accounts for one person;
- breaking any other rules set forth in these Terms and Conditions.
2.You shall, in particular:
- not make any attempt to decompile or reproduce the gaming software used on or in playTIcasino and the playTIcasino apps, not interfere with it in any other way, and not develop or use any software that interferes with the gaming software used on playTIcasino and the playTIcasino apps and any client-server communication in connection therewith;
- not use any type of software permitting the use of artificial intelligence or allowing opponent profiling or user collusion;
- not use any software which at Treasure Island's sole discretion is regarded as a program allowing a user to cheat or giving a user an unfair advantage over another player;
- use the games and services at the playTIcasino website exclusively with an Internet browser;
- refrain from using any scripts which are not authorized by Treasure Island;
- not use any software which allows a user to analyze or reproduce the website, playTIcasino and playTIcasino apps or individual games and/or their programming in any other way;
- not use any program causing an excessive burden on the server.
3.Treasure Island reserves the right to take the necessary steps, if required, to detect and prevent the use of such software by users, including but not limited to identifying and detecting the programs installed on the user's computer or (mobile) device, or profiling a player's behavior for reasons of investigation. Should the Operator detect, or suspect with good reason the use of such prohibited software, the Operator shall be entitled to suspend or terminate the relevant player's account for a limited time or permanently, deny access to or revoke the license for any Virtual Items associated with such account and to deny access to any or all playTIcasino and the playTIcasino apps.
H.Communication and Other Conduct between Players
1.You assume liability that any user content generated by him/her does not violate any legal provisions or third party rights. Specifically, the user undertakes to respect the privacy of other users, and to refrain from any offensive, immoral, objectionable, National Socialist, racist, xenophobic, discriminatory, pornographic, or sexually degrading statements or statements that glorify violence and from placing any such contents, as well as from any kind of threats or harassing behavior.
2.The following is also prohibited:
- the distribution of advertising;
- conducting surveys;
- the distribution of chain letters;
- the use of the term 'administrator';
- spying out the personal data of other users without their explicit consent;
- spreading viruses, worms, etc. and any other activity affecting other computer systems and programs;
- messages that serve the exclusive purpose of spreading religious, political and ideological convictions;
- bothering other users by entering senseless combinations of characters, etc.;
- deliberately blocking games and communication processes in any way.
I.Sanctions for Improper Conduct
The Operator reserves the right to instantly terminate the contract of any users who conduct themselves contrary to the rules stated in these Terms and Conditions. The Operator also has the right to terminate any ongoing games, block an account or ban a user with or without prior notice and delete or withhold Coin credits where applicable.
J.Termination
1. You or Treasure Island may terminate this agreement with immediate effect at any time and without stating a reason. For you to terminate, you must send an e-mail with your name and account name to support@playticasino.com and a request to terminate your account. The deletion of the account will be carried out once security questions have been correctly answered. If the correct answer to the security questions cannot be provided, a copy of a current and official proof of identity must be sent to support@playticasino.com. The details on the ID must match those in the account. In terminating the contract the user loses all claims to his/her account and to any services, contents, virtual goods and virtual currencies which become revoked upon termination.
2.Should an account not be logged into over a period of 6 months, it may be deleted due to lack of activity and the Terms and Conditions may be terminated.
3.Upon termination of your account for any reason, you will be denied further access to playTIcasino and Treasure Island Apps and any license to Virtual Items shall terminate. You acknowledge that upon termination, you no longer will have any access to your account or any feature associated with your account, including contents virtual goods, virtual currencies or other Virtual Items in the account, without any compensation from Treasure Island.
K.'Bonus Coins' (Bonus Virtual Coins)
1.You may be awarded bonus virtual currency called ‘Coins' for undertaking certain actions. Coins can only be acquired and used in the various games and playTIcasino apps on the platform. Coins shall be deemed Virtual Items and subject to all of the relevant Virtual Items provisions in this agreement.
2.How bonus Coins are awarded is explained in detail in 'FAQs' under the Help section of the playTIcasino website. The Operator reserves the right to make changes to the method(s) bonus Coins are awarded at any time or to cease issuing bonus Coins. Treasure Island also may make changes to how the Coins can be used and these changes may impact the perceived value of these Coins. Treasure Island shall not be liable to you for any change of perceived value of the Coins.
3.You may have the opportunity to acquire Coins without charge for your activities on playTIcasino and the playTIcasino apps. Coins may also be available for a fee in the Coin Store or otherwise in playTIcasino playTIcasino apps For further information on this topic, please see point M – Virtual Currency.
L.playTIcasino Apps
1.The Operator offers selected games both on and off the website as downloads for the user's mobile devices. The technical configuration of the user's terminals used for that purpose is entirely the responsibility of the user.
2.playTIcasino Apps may be offered for iOS and Android smartphones and tablet platforms and on other certain iOS and Android devices meeting minimum operating system requirements, in Treasure Island's sole discretion, which may change from time to time
3.By registering, you agree to make the following details concerning your device available to Treasure Island in an anonymous form for the purpose of error correction, quality improvement of the app and other purposes consistent with this agreement and the Treasure Island Privacy Policy: version number of the playTIcasino app used, your device model and type and version number of the operating system, free capacity, process cycle of the app, display characteristics, hardware configuration and software environment, system settings, system log-file and, if applicable, information on the inbuilt radio receiver and its configuration.

Treasure Island can change the price for access to or features of any playTIcasino apps at any time, in its sole discretion. If you do not wish to proceed with any new pricing, you may terminate your use of the playTIcasino apps. You agree that you have no right (and waive any claim that you have a right) to claim any compensation if any playTIcasino apps that you downloaded are no longer offered or are offered under limited or changed conditions.
7.The playTIcasino apps are protected by the copyright and trademark rights of Treasure Island. You may use a copy of the playTIcasino apps on your device for personal use subject to the terms of the End User License Agreement which accompanies the download of any such app. Any other form of saving, copying, any other processing or distribution of the game by the user is strictly forbidden.
M.Virtual Currency
1.Treasure Island may allow you to acquire a revocable license to use virtual goods, virtual currency or other virtual items ('Virtual Items') solely for use with playTIcasino and the playTIcasino apps on the terms set forth herein, which may be modified by Treasure Island. In Treasure Island's sole discretion, the Virtual Items offered for and/or usable with any game may vary and such terms shall be provided with the game.
2.The license granted to you for any Virtual Items that you acquire is a limited, non-transferrable, revocable license to use the Virtual Items within the scope of and in accordance with conditions established by Treasure Island for any given game. You do not own any of the Virtual Items or acquire any other rights therein.
3.Irrespective of any terminology used in connection with playTIcasino and the playTIcasino apps when you purchase or otherwise acquire any Virtual Items, you are only acquiring a limited, non-transferrable, revocable license to use the Virtual Items in accordance with these Terms and Conditions. The Virtual Items are for entertainment purposes only and have no monetary value. No refund, redemption or compensation in real money will be provide. If you violate these Terms and Conditions or if for any other reason your account is terminated, your license to the Virtual Items shall be immediately terminated, without any compensation to you.
4.The license to Virtual Items is non-transferable. All accounts and associated data are owned by Treasure Island. You do not own your account. You shall not transfer your account or any Virtual Items to any third party. Any purported transfer shall be void and a breach of this agreement. The Virtual Items offered can be found on playTIcasino and the playTIcasino apps. Treasure Island reserves the right to change, reduce and/or increase the offer of Virtual Items, and to adjust the prices or methods of acquisition of Virtual Items at any time without giving a reason. Furthermore, Treasure Island is entitled, at its discretion, to cease offering Virtual Items or making them available free of charge or for a fee. In exercising that right, Treasure Island shall have no liability to you for any perceived change in value of the Virtual Items. You shall not be entitled to any compensation should the Virtual Items licensed to you be withdrawn, or provided upon different conditions, regardless of whether said Virtual Items are offered on a temporary or permanent basis. Moreover, the Operator has the right to delete or change the player account and its associated player history and/or virtual currencies at any time and without giving a reason. In that case you are entitled to terminate the contract with immediate effect.

7.The primary real world currency used for payments to acquire virtual currencies on the website is the United States Dollar ($). 8.Payment for virtual currencies with real money can be made using different payment methods found on playTIcasino and the playTIcasino apps using the payment methods of third party suppliers. 11.Treasure Island is entitled to publish all pictures and videos transferred in the game by you (completely or any parts thereof) and use them in any way mentioning your display name. The foregoing also applies to videos, pictures, or other content created by the user. When transferring or creating videos or pictures you explicitly agree to permit this reporting and irrevocably grant Treasure Island an irrevocable, perpetual royalty free license for use, exploitation, publication, editing and duplication for the above mentioned reporting free of charge, without limitation as to the subject-matter, time and location. You agree you shall not make any claim for compensation for the foregoing.

II.LIABILITY

G.Proper Conduct
1.Improper conduct on playTIcasino and the playTIcasino apps is strictly prohibited, and you agree not to engage in such activity, including but not limited to:
- breaking the rules regarding communication between users (see point H);
- deliberately submitting false or misleading information;
- any attempt to influence the result of a game by collusion, tampering with the program or by any other means contrary to the rules;
- causing malfunctions or failure deliberately in order to influence the course of a game;
- creating several gaming accounts for one person;
- breaking any other rules set forth in these Terms and Conditions.
2.You shall, in particular:
- not make any attempt to decompile or reproduce the gaming software used on or in playTIcasino and the playTIcasino apps, not interfere with it in any other way, and not develop or use any software that interferes with the gaming software used on playTIcasino and the playTIcasino apps and any client-server communication in connection therewith;
- not use any type of software permitting the use of artificial intelligence or allowing opponent profiling or user collusion;
- not use any software which at Treasure Island's sole discretion is regarded as a program allowing a user to cheat or giving a user an unfair advantage over another player;
- use the games and services at the playTIcasino website exclusively with an Internet browser;
- refrain from using any scripts which are not authorized by Treasure Island;
- not use any software which allows a user to analyze or reproduce the website, playTIcasino and playTIcasino apps or individual games and/or their programming in any other way;
- not use any program causing an excessive burden on the server.
3.Treasure Island reserves the right to take the necessary steps, if required, to detect and prevent the use of such software by users, including but not limited to identifying and detecting the programs installed on the user's computer or (mobile) device, or profiling a player's behavior for reasons of investigation. Should the Operator detect, or suspect with good reason the use of such prohibited software, the Operator shall be entitled to suspend or terminate the relevant player's account for a limited time or permanently, deny access to or revoke the license for any Virtual Items associated with such account and to deny access to any or all playTIcasino and the playTIcasino apps.
H.Communication and Other Conduct between Players
1.You assume liability that any user content generated by him/her does not violate any legal provisions or third party rights. Specifically, the user undertakes to respect the privacy of other users, and to refrain from any offensive, immoral, objectionable, National Socialist, racist, xenophobic, discriminatory, pornographic, or sexually degrading statements or statements that glorify violence and from placing any such contents, as well as from any kind of threats or harassing behavior.
2.The following is also prohibited:
- the distribution of advertising;
- conducting surveys;
- the distribution of chain letters;
- the use of the term 'administrator';
- spying out the personal data of other users without their explicit consent;
- spreading viruses, worms, etc. and any other activity affecting other computer systems and programs;
- messages that serve the exclusive purpose of spreading religious, political and ideological convictions;
- bothering other users by entering senseless combinations of characters, etc.;
- deliberately blocking games and communication processes in any way.
I.Sanctions for Improper Conduct
The Operator reserves the right to instantly terminate the contract of any users who conduct themselves contrary to the rules stated in these Terms and Conditions. The Operator also has the right to terminate any ongoing games, block an account or ban a user with or without prior notice and delete or withhold Coin credits where applicable.
J.Termination
1. You or Treasure Island may terminate this agreement with immediate effect at any time and without stating a reason. For you to terminate, you must send an e-mail with your name and account name to support@playticasino.com and a request to terminate your account. The deletion of the account will be carried out once security questions have been correctly answered. If the correct answer to the security questions cannot be provided, a copy of a current and official proof of identity must be sent to support@playticasino.com. The details on the ID must match those in the account. In terminating the contract the user loses all claims to his/her account and to any services, contents, virtual goods and virtual currencies which become revoked upon termination.
2.Should an account not be logged into over a period of 6 months, it may be deleted due to lack of activity and the Terms and Conditions may be terminated.
3.Upon termination of your account for any reason, you will be denied further access to playTIcasino and Treasure Island Apps and any license to Virtual Items shall terminate. You acknowledge that upon termination, you no longer will have any access to your account or any feature associated with your account, including contents virtual goods, virtual currencies or other Virtual Items in the account, without any compensation from Treasure Island.
K.'Bonus Coins' (Bonus Virtual Coins)
1.You may be awarded bonus virtual currency called ‘Coins' for undertaking certain actions. Coins can only be acquired and used in the various games and playTIcasino apps on the platform. Coins shall be deemed Virtual Items and subject to all of the relevant Virtual Items provisions in this agreement.
2.How bonus Coins are awarded is explained in detail in 'FAQs' under the Help section of the playTIcasino website. The Operator reserves the right to make changes to the method(s) bonus Coins are awarded at any time or to cease issuing bonus Coins. Treasure Island also may make changes to how the Coins can be used and these changes may impact the perceived value of these Coins. 7.The playTIcasino apps are protected by the copyright and trademark rights of Treasure Island. You may use a copy of the playTIcasino apps on your device for personal use subject to the terms of the End User License Agreement which accompanies the download of any such app. Any other form of saving, copying, any other processing or distribution of the game by the user is strictly forbidden.
M.Virtual Currency
1.Treasure Island may allow you to acquire a revocable license to use virtual goods, virtual currency or other virtual items ('Virtual Items') solely for use with playTIcasino and the playTIcasino apps on the terms set forth herein, which may be modified by Treasure Island. In Treasure Island's sole discretion, the Virtual Items offered for and/or usable with any game may vary and such terms shall be provided with the game.
2.The license granted to you for any Virtual Items that you acquire is a limited, non-transferrable, revocable license to use the Virtual Items within the scope of and in accordance with conditions established by Treasure Island for any given game. 4.The license to Virtual Items is non-transferable. All accounts and associated data are owned by Treasure Island. You do not own your account. You shall not transfer your account or any Virtual Items to any third party. Any purported transfer shall be void and a breach of this agreement. The Virtual Items offered can be found on playTIcasino and the playTIcasino apps. Treasure Island reserves the right to change, reduce and/or increase the offer of Virtual Items, and to adjust the prices or methods of acquisition of Virtual Items at any time without giving a reason. Furthermore, Treasure Island is entitled, at its discretion, to cease offering Virtual Items or making them available free of charge or for a fee. In exercising that right, Treasure Island shall have no liability to you for any perceived change in value of the Virtual Items. You shall not be entitled to any compensation should the Virtual Items licensed to you be withdrawn, or provided upon different conditions, regardless of whether said Virtual Items are offered on a temporary or permanent basis. In case of suspicion of fraud, violation of laws or of these Terms and Conditions, Treasure Island has the right to freeze acquisition processes and the related payment transactions until the situation has been clarified. 11.Treasure Island is entitled to publish all pictures and videos transferred in the game by you (completely or any parts thereof) and use them in any way mentioning your display name. The foregoing also applies to videos, pictures, or other content created by the user. When transferring or creating videos or pictures you explicitly agree to permit this reporting and irrevocably grant Treasure Island an irrevocable, perpetual royalty free license for use, exploitation, publication, editing and duplication for the above mentioned reporting free of charge, without limitation as to the subject-matter, time and location. You agree you shall not make any claim for compensation for the foregoing.
12.Treasure Island may permit you to gift Virtual Items to other users, under limited conditions, which it may specify on playTIcasino and Treasure Island Apps. Any gifting or attempted gifting in violation of the conditions are void and may cause termination of your account.
II.LIABILITY
1.The Operator assumes no liability for loss or damage of any kind arising from the improper use of the account by the user. The Operator is not to be liable for any damages whatsoever arising from the improper use of the account.
2.The Operator assumes no liability for user content, however, the Operator reserves the right to delete any content that infringes upon the conditions of use or any legal provisions as soon as any such content becomes known, and to pass any such infringing content on to the appropriate law enforcement authority.
